ok a friend of mine is charged with b+e and conspericy to commit b+e.
right now the b+e charge wont hold up in court, but the conspericy will.
this is the persons first offence as a adult.
the current offers hes looking at is 7 years probation or 5 years suspended? at the end of all records will be cleard.

i was wondering if anyone had any ideas on this?
im thinking 7 years probation is a little much for this crime.
even if he pleads nolo what would be the punishment?

If he has a juvenile record they are probably looking at that as well (it is bullshit that your juvenile records are sealed when you turn 18) and are giving hima nice deal. The main thing that does not make sense here is you said at the end his record will be cleared. I have neve heard of this in my lifetime. They can give him a continuance without a finding (unsupervised probation and if you stay out of trouble during the time they give you it goes in as a dismissal of the charges). However, a continuance without a finding usually lasts for 6 months to a year. If you plea and get probation that will definitely be on your permanent record. My advise is to get a lawyer and let the lawyer get youa better deal.

Myself, I would tell them I would rather take it to trial and take my chances with a jury. This would probably force the prosecution to give you a better deal, but you are still taking a chance. It works the same for personal injury settlements. Never take the first offer. Call their bluff and the second offer is the real one.

If I get in trouble again I want to go on People's Court.

the person has a lawyer and thats the deal the Da gave 7 years probation or suspended or somthing (ill cheak and get back to you)
but 7 years probation when someones 21 is a long time. etc..

my friend drove 2 other individuals to a place were they proceeded to break in and steal things. My friend stayd in the car and dident enter the property.
A few months later someone mentiond somthing to the cops and all 3 were arrested and my friend was charged with. B & E/night/ felony, and CONSPIRACY/FELONY.

It's probably a 5 year sentence suspended for 7 years. (ie he'd be on probation for 7 years and if he fucks up during those 7 years he has to do the 5). That does seem harsh for a 1st offense but it depends on what was stolen.

Legally, since he was the driver and knew what was going on, he might as well have broken in there himself.

What does his lawyer say? If he doesn't have one, get one now. In Mass. I've found even public defenders are pretty damn good. There is the occasional stereotypical drunken bum public defender who's totally useless, but that's rare. Most of them are really good and LOVE pissing off prosecutors.

I believe this law breaking story is a farce. An old friend who has done numerous years in jail just got arrested for running someone over with his car. Reporting his car stolen after he proceeded to light it on fire in a parking lot, not realizing there were security cameras everywhere. He is looking at 5 years max, with about 18 months to serve.

Oh yeah, in case your wondering. You mentioned that someone told the cops and all three were arrested. Well, it had to be one of the three.
