Being in the vehicle, behind the wheel, with the keys in the ignition, car turned on, is by the legal definition drunk driving. The car doesn't even have to be moving, or in gear. That's why if you are ever drunk and want to sleep it off in your car, DO NOT turn the car on for heat or to listen to the radio. The cops can nail you for drunk driving.
