same thing goes for a supermarket.
You're texting, walking along and slip on some spilt apple juice, who's fault is it? The person texting or the store's fault for not having a safe store to shop in?
Sounds ridiculous, but it's never the person's fault in general liability situations like this. If the company/store had the means to clean it up and employees on the job, THEY are liable for the protection of the customers, no matter what the customer does. Of course, if the customer gets hurt on purpose (happens all the time so people can get money) then they'd have to examine the evidence in court.
people, it's not hard taking advantage of situations for money. I'd suggest that if anyone sees an unattended manhole in MA, fall down it and bust an ankle, then sue for potential loss of life. Simple money
